New Protections for Michigan Service Members Facing Foreclosure

Michigan has passed a bill to help military service members facing foreclosure. According to the Detroit News, the number of homes in Michigan facing foreclosure doubled from 2004 to 2006. The rate of foreclosure there is a whopping 2 1/2 times the national average. The Michigan legislature has taken action to help shield military service members from the devastating blow of threatened foreclosure.

Under the amended law, a court is authorized to stay judicial foreclosure proceedings until six months after a service member’s period of military service. The bill also prohibits a non-judicial foreclosure sale from occurring at any time while the borrower is in military service or within 6 months after the end of military service.

The new statute (Senate Bill No. 749) amends the state’s foreclosure laws to provide certain protections for military service members involved in foreclosure proceedings. This new law (actually an amendment to current law) applies to service members who are deployed in overseas service, as well as to service members not stationed overseas who had entered into the mortgage before becoming a service member.

“Service member” means an individual who is in military service and is a member of the armed services or U.S. reserve forces or a member of the Michigan national guard.

The amended law applies to mortgages or land contracts entered into on or after May 21, 2008.

    Well, I wonder if this is too little, too late? Is there any data that this has really helped? In most cases foreclosures happen because people don’t communicate. Dale
